Shenzhen's reform program: the 19 points

Editor's note: Shenzhen has recently announced a program outlining 19 points of future reform initiatives. Offered below is a detailed translation of the first 8 points that focus on political, governmental and administrative reforms, and a brief translation of the remaining 11 points which mainly deal with economy, society, education, health, and culture.
Recent reform initiatives of Shenzhen city
1. Promote intra-Party democracy. Explore and expand various forms of intra-Party democracy;
a) Fully adopt a fixed-term Party congress system at the district level; administer a tenure system for the deputies of Party congresses on a trial basis. Implement a mechanism that connects the deputies with the public by encouraging them to submit proposals, inquiries and questions, as well as conduct research and investigations. Improve the system whereby the standing Party committee regularly reports its work to plenary sessions of the Party Committee and accepts their oversight.
b) Improve the intra-Party electoral system by securing the democratic electoral rights of the party members. Introduce a competition mechanism to the intra-Party elections and gradually extend direct election of leading members in primary Party organizations to more areas. Standardize the differential voting system at city and district levels, increase the number of contestants, and allow candidates (including self-nominated and Party member nominated candidates) to organize campaigns within a certain scope.
c) Establish an inquiry and recall mechanism within the Party; implement such a mechanism for Party committee members and members of the Discipline Inspection Commission in pilot areas.
d) Important decisions in standing Party committees and party organizations should be made through anonymous electronic votes, in order to reflect the will of the majority.
2. Promote basic-level democratic elections; reinforce the foundation of socialist democracy;
a) Implement the differential voting system in district governmental elections; increase the number of candidates for deputy district heads. Candidates can deliver public speeches and organize debates within a certain scope; district heads and deputy district heads shall be elected by the same-level People's Congress. Experiences drawn from these practices shall be used in mayor elections, when the time becomes appropriate.
b) Extend the scope of grassroots self-government by fully promoting direct elections in neighborhood committees.
c) Adapt to new situations in social transformation; research and determine the boundaries between government administration and civic self-government; take advantage of the positive roles community self-government organizations and other civil society organizations play in social governance.
3. Give full play to the People's Congress and its standing committee, encourage innovation and development of the duties of the People's Congress;
a) Improve Party leadership over the People's Congress; give full play to the role of the People's Congress in the democratic politics with Chinese characteristics. Adjust the institutions within the People's Congress; configure human resources based on the needs of legislation, supervision and representation. Gradually increase the proportion of full-time members of the standing committee, perfect its working mechanism.
b) Strengthen the legislative role of the People's Congress; take full advantage of the legislative privileges given to the Special Economic Zone. Strengthen the legislative system of the municipal People's Congress; promote scientific and democratic legislation. Resolve the problem of "department legislation" by reasonably defining the rights and responsibilities of the municipal People's Congress and the municipal government in drafting laws and regulations; explore a new system of professional legislation.
c) Further strengthen the role of the People's Congress in budget planning and oversight; all government revenue and expenditure shall be supervised by the People's Congress; major expenditures must be reported promptly to the People's Congress for verification and approval. Establish a system whereby the government is held accountable to the People's Congress for its errors in budget expenditure; increase the effectiveness of the People's Congress in budget planning and oversight.
d) Explore and improve the relevant systems, strengthen the People's Congress's role in supervising elections as well as overseeing personnel appointments and removals.
e) Promote direct voting in selected district-level People's Congress elections in order to strengthen the public base of the Party. The government will allocate special funds to set up workstations for People's Congress deputies, where public opinion and inquiries can be reflected and channeled. Give better play to the role of the People's Congress deputies by encouraging them to participate in community activities.
f) Broaden political participation of all citizens, improve the democratic electoral process, and ensure the electoral rights of the People's Congress deputies.
4. Perfect the Chinese People's Political Consultative Conference (CPPCC) in political consultation; continuously improve its professional functions;
a) Strengthen the CPPCC's functions in terms of its institutionalization, standardization and operating procedures, so that political consultations will become an indispensable part of major decision-making processes.
b) Reasonably configure and adjust sectors within the CPPCC; optimize the structure of the members of the CPPCC and its standing committee; broaden the representativeness of the CPPCC delegates. Absorb new social classes into the CPPCC framework by identifying various social sectors, professional associations and interest groups. Channel demands and opinions from different social classes through the CPPCC framework.
c) Properly expand the scale of the CPPCC based on population proportions; explore a new mechanism for member selection; improve the management system.
5. Deepen reform of the judicial system. Ensure the legal and independent exercise of judicial and procuratorial power;
a) Under Party leadership, discover new methods of optimizing the configuration of judicial authorities in order to regulate judicial behavior and promote judicial justice.
b) Drawing from successful international experiences, boldly explore and build an independent judicial system; improve the people's jury system; clarify judges' responsibilities.
c) Steadily promote the reform on the professionalization of judicial personnel; strengthen the internal supervision mechanism of the judicial branch; improve transparency; prevent corruption within the judiciary.
d) Establish a strict system to regulate and strengthen the external supervision of the judiciary. Prevent interference in judicial independence from any organization or individual.
6. Promote institutional innovation in anti-corruption measures; curb corruption at its source;
a) Borrowing Hong Kong's ICAC (Independent Commission Against Corruption) model, study and create a working agency and an operating model for anti-corruption in Shenzhen city. Empower such an agency by Special Economic Zone legislative privileges; expand its supervisory jurisdiction and functions; allow it necessary means to strengthen the city's anti-corruption efforts.
b) Explore new management systems of the anti-corruption agency. Improve the works of municipal Discipline Inspection and supervision teams, whose efforts shall be extended to the district level and directly supervised at the neighborhood level by superior anti-corruption agencies. Personnel in such agencies will be configured by the municipal government and rotated on a regular basis.
c) Reinforce the building of an anti-corruption system. Establish and improve an anti-corruption legal system by taking full advantage of the Special Economic Zone's legislative privileges. Explore systems such as gift registration and post-employment restrictions in order to prevent public servants from gaining illegal advantages. Improve the degree of transparency in anti-corruption efforts by establishing a property declaration system for governmental and Party officials and improving the notification system for major cases.
d) Draft a suggestion on building a "sunshine government"; promote E-government projects by using advanced information technology; improve five systems comprising online administrative approval, administrative law enforcement, public resources transactions, public service and real-time monitoring. Governments of all levels should perfect open government systems by ensuring access to information and the public's right of knowing, expression, participation and supervision.
e) Establish an effective mechanism for media supervision of the government; ensure the media's rights and autonomy. Take advantage of the supervisory role of the internet; gather public opinion through diverse media channels before making major decisions. Respect media supervision of the Party and the government; no organization or individual should retaliate against or block media reports.
7. Deepen reform of the cadre personnel system; nurture a vibrant institutional environment that encourages talents;
a) Enact a standard for selecting and appointing cadres in accordance with the requirements of the Scientific Outlook on Development and a correct view on evaluating cadres' performances.
b) Improve key democratic mechanisms, such as the cadre nomination and the decision making systems. Reform and improve the initial nomination rights for selecting and appointing cadres; establish a public nomination system for the nomination, self-nomination, and appointments of cadres in order to widen the candidate pool of cadres. For district Party and government leaders and municipal department heads, gradually establish a secret ballot system for the nomination of candidates in the enlarged meeting of the Standing Committee of the municipal Party Committee. Candidates with high votes, self-nominated candidates and jointly-nominated candidates shall conduct public speeches and debates. Decisions shall be made by the Standing Committee through differential voting.
c) Establish and improve a system where cadres will receive education and training on a regular basis. Promote interagency exchange of department heads at district and municipal levels; encourage interagency personnel exchange at other levels. Resolve the agency problem through personnel configurations.
d) Establish and perfect a standardized system for cadre assessment, promotion and removal; strengthen the cadre evaluation system and incentive mechanism at all levels.
8. Deepen administrative reform based on the needs of the transformation of government roles, the optimization of government structure, the enhancement of administrative efficiency, and the strengthening of supervision systems;
a) In accordance with the new round of government agency reforms and the requirements of developing a socialist market economy, further the transformation of government roles so that it focuses on social administration and public service; resolve the problems caused by the lack of government intervention as well as too much or too little government intervention.
b) Further emancipate minds. Innovatively restructure the government system by learning from Hong Kong and Singapore's experiences. Establish a mechanism where decision-making, executive and supervisory powers are appropriately separated while being coordinated. Study and reasonably define the jurisdictions of various administrative agencies; optimize the management of the "super ministries system"; promote reforms in areas such as the drafting of administrative regulations, urban planning, and industrial policies.
c) Streamline government by promoting flat management, reducing administrative costs, and increasing administrative efficiency. A streamlined administration will be carried out as a pilot in Guangming New District.
d) Promote organic unity within industrialization, urbanization and modernization by exploring new methods in administrative districting and management system reforms. Establish functional areas of urban development.
e) Perfect the decision-making process of public policy making. Establish an evaluation system for the public hearing, community consultation, and expert verification of important issues. Improve the scientific and democratic levels of decision making and the supervision system of public power.
f) Learn from international experience in urban management; explore a new system wherein the police will assume the duties of urban management.
g) Strengthen administrative accountability by introducing a resignation system. Establish an indication system and a legal system for the evaluation of government effectiveness; improve the evaluation indicator system and the incentive/punishment mechanism. Clarify the range of accountabilities, normalize inquiry procedures, increase oversight to strengthen accountability, and strengthen the executive power and credibility of the government.
9. Encourage innovation in state-owned assets operation and management; promote the competitiveness and safe appreciation of state-owned economy;
10. Accelerate the development of various markets for factors of production, and improve the local government's system for macroeconomic regulation and control;
11. Deepen reform of the financial management system; establish a public financial system in accordance with the existing authorities;
12. Encourage innovation and reform in the financial sector; promote healthy development of the financial industry;
13. Deepen reform of the existing joint-stock rural cooperative economy; promote balanced development in and outside the Special Economic Zone;
14. Deepen reform of the public institutions in order to actively promote innovation in public service management and operational systems; establish a just, fair, appropriate and sustainable public service system that benefits all;
15. Deepen reform of public utility supervision; promote the organic unity between public utility and enterprise;
16. Deepen reform of the education system; develop a balanced, fair, future-oriented education system that satisfies the people's needs;
17. Deepen reform of the medical and health systems; improve the quality of medical services;
18. Promote innovation of the social system; give full play to the role of civil society organizations in public administrative affairs;
19. Continuously deepen cultural restructuring; promote vigorous development and prosperity of socialist culture.
